Sushil Ansal Seeks To Withdraw Suit Against Web Series On Uphaar Cinema Fire
Real estate tycoon Sushil Ansal, convicted in the 1997 Uphaar cinema fire case, on Tuesday submitted before the Delhi High Court that he wishes to withdraw a suit seeking to restrain the release of web series "Trial by Fire".
The series, inspired by the tragedy, streamed on Netflix on January 13 as the high court refused to stay its release and dismissed an application for the interim stay.
A massive fire had broken out at the Uphaar cinema during the screening of the Hindi film "Border" on June 13, 1997, claiming 59 lives.
On Tuesday, the suit was listed for completion of pleadings before Joint Registrar (Judicial) Vandana Jain.
The counsel for Sushil Ansal submitted before the joint registrar that "she wishes to withdraw the present suit and requests for placing the matter before the court".
At the request of the counsel, the joint registrar fixed the matter for April 17 for further directions before the bench which had passed the interim order.
While dismissing the interim application to stay the release of the web series, Justice Yashwant Varma on January 12, observed that the unimaginable tragedy made the "nation bow its head in shame".
Ansal, who alleged defamation, had urged the court to grant an injunction against the release of the web series, saying even its teaser got 1.5 million views in four days which shows the immediate impact it has.
As the 83-year-old Ansal, one of the owners of the cinema hall, also sought to restrain the circulation and publication of a book titled "Trial by Fire- The tragic tale of the Uphaar Tragedy", the court had said that for the reasons best known to him, he chose not to initiate any injunctive action in respect of the literally work when it came to be originally published on September 19, 2016.
The book was authored by -- Neelam and Shekhar Krishnamoorthy -- who lost their two children in the blaze.
"A slothful or sluggish plaintiff seeking an injunction of the nature which is sought in these proceedings cannot be allowed to claim such reliefs," the high court had said.
It had said the work on which the web series is based has been penned by parents who had lost their teenage children in the unfortunate incident and it is a story which alleges a systemic failure, manifests a cry of anguish against the manner in which the incident was prosecuted and tried.
It also taken into consideration the disclaimer which is proposed to preface the web series which merely claims to be "inspired" by the book.
Ansal had claimed the web series directly attacks his personality.
Ansal's plea was vehemently opposed by the counsel for the producers of the web series, Netflix and authors of the book -- the parents.
In his plea, Ansal had said he has been "punished both legally and socially" and the release of the series, based on the book written by a couple who lost their two children to the fire, will cause irreparable harm to his reputation and breach his right to privacy.
"The events are causing and will cause loss of reputation of the plaintiff, public trial, humiliation, stigmatisation and irreparable injury along with causing grave prejudice to the revision petitions pending before this court arising out of the (evidence) tampering case," the suit had said.
In 2017, the Supreme Court had finally decided the Uphaar cinema blaze case and directed the now 83-year-old Sushil Ansal and his brother Gopal Ansal (74) to pay a fine of Rs 30 crore each.
The top court had then released Sushil Ansal taking into account the period he had already spent in jail.
The Ansal brothers and two others were later held guilty of tampering with the evidence related to the trial.

While a car's safety is mainly dependent on the actions of drivers, a city's infrastructure can play a part as well. Speed bumps, or speed breakers, are also essential to keep cars and other vehicles at a safe speed in residential areas. However, one-speed bump in Mumbai is gaining traction online for a precarious reason.
A car recently got stuck on a high-speed controller in Mumbai and became helpless, so everything went awry. Taking to Instagram, one user shared a video showing a Jaguar XJ stuck on the speed breaker in Mumbai. "Why dont we have proper roads in Financial Capital???" the user wrote in the caption.

In the video, a Jaguar XJ can be seen stuck over a large speed breaker on a busy road in Mumbai. Despite a lot of attempts by the car's driver, the vehicle failed to cross the speed breaker, with its rear wheels continuing to spin at every attempt.
The clip also showed how other motorists and passers-by came to the rescue of the Jaguar driver. The people who gathered around the vehicle were seen pushing the car so that it inches ahead and goes past the speed breaker. Fortunately, at the end of the video, the vehicle managed to cross the high-speed controller and evade further damage and ordeals.
Since being shared, the video of the incident has taken the internet by storm. It even caught the attention of Mumbai's Municipal Corporation. "Thank you for sharing with us. We have intimated our team to attend this immediately," the officials wrote on Twitter.

Meanwhile, the video has accumulated nearly 30,000 views and several likes and comments. "Literally laughing my guts out.. Any car specifically sedans that are not made with Indian Roads in mind should not be Bought only," wrote one user. "its not a 'speed breaker', its a 'car breaker'," jokingly added another.
"Why isn't there a universal size for speed breaker!? A universal template should be followed by every contractor. All mumbai speed breakers are ridiculous," expressed third. "Why its called speed breaker, it should be called speed mountain," said another.

Manish Sisodia, Satyendar Jain Should've Quit Delhi Cabinet Earlier: BJP
The BJP on Tuesday described AAP as a party of "cut, commission and corruption" and said its leaders Manish Sisodia and Satyendar Jain should have resigned from the Cabinet much earlier when the graft allegations against them had come to light.
Deputy Chief Minister Sisodia was arrested by the CBI on Sunday evening in connection with alleged corruption in the formulation and implementation of the now-scrapped Delhi liquor policy for 2021-22, while Jain is lodged in Tihar Jail in a money laundering case since May last year.
The ministers on Tuesday tendered their resignations to Chief Minister Arvind Kejriwal, which has been accepted.
Hitting out at the Aam Aadmi Party (AAP) and its national convener Mr Kejriwal, senior BJP leader Ravi Shankar Prasad said people who claimed to be the "flag bearers of the fight against corruption" have ensured governance that "increases the number of alcohol users in Delhi".
Without naming any party, Mr Prasad said he thought cut and the commission was the legacy of only one political party.
"But today, I must say that 3C-cut, commission, and corruption also applies to Mr Kejriwal's party," Mr Prasad said and added that AAP leaders have defamed the anti-corruption agitation led by Anna Hazare.
"They should have resigned earlier. Mr Jain has resigned several months after his arrest and Mr Sisodia should have resigned at the time when the allegations against them came out," the former law minister said while addressing a press conference here.
Describing the liquor scam case in Delhi as a "fixed textbook case of corruption", Mr Prasad said the BJP will raise the issue in every corner of the country.
He said the Supreme court on Tuesday refused to "grant any indulgence to one of the "most prominent faces of the anti-corruption movement led by Anna Hazare".
"This clearly indicates the merit of Sisodia's plea that the Supreme Court refused to grant any relief," Mr Prasad said.
The Supreme Court on Tuesday refused to entertain the bail plea of Mr Sisodia, who is in CBI custody in connection with the excise policy case.
Mr Sisodia is perhaps the only education minister in the country who is also a "liquor minister", the BJP leader said.
On Arvind Kejriwal, Mr Prasad said that during the Gujarat elections, he claimed that the Intelligence Bureau was reporting a big win for the AAP, and on Monday, he claimed that the CBI was not in favour of Sisodia's arrest.
"I am amazed at the number of lies spewed by Mr Kejriwal for the commission from liquor," he said.
