"Came Out By Breaking Windows": Maharashtra Bus Crash Survivors

Some of the survivors of the ill-fated bus that caught fire and led to the death of 25 passengers in Maharashtra's Buldhana district on Saturday, said they managed to come out of the burning vehicle by breaking its window.

The private sleeper coach bus, which was travelling from Nagpur to Pune, met with an accident at Pimpalkhuta village near Sindkhedraja on the Samruddhi Expressway as it rammed into a road divider around 1.30 am on Saturday. Of the 33 passengers travelling on the bus, 25 were charred to death, police said.

Eight others, including the bus driver and its cleaner, survived, they said.

After hitting the divider, the bus overturned and fell on its right side with the entry/exit door facing the sky, they said.

"A tyre of the bus burst and the vehicle caught fire immediately. The blaze spread in no time," one of the survivors said.

"The passenger sitting next to me and I managed to escape by breaking the rear window," he said.

The survivor said that after the accident, teams of police and fire brigade reached the site quickly.

Another survivor, Ayush Ghatge, said it was a miracle that he survived the horrific accident.

He said he boarded the bus at Butibori, an industrial suburb of Nagpur.

"I was on the last seat and sleeping when the accident took place. I woke up when a few people fell on me following the accident. I immediately stood up and started looking for a window to come out. I started breaking a window and three of us came out with each other's help," Ghatge said.

Relatives of Avani Pohnekar, who died in the accident, told a TV channel that she was an IT engineer on way to Pune to explore job opportunities.

"She was going to Pune from Wardha. We later found out that Avani was among the 14 passengers who had boarded this bus from Wardha," they said.

A local resident said four to five passengers managed to escape by breaking one window of the bus.

"But not everyone could do it," he said.

The people who could come out of the bus later told us that they sought help from other vehicles on the highway, but nobody stopped, he added.

"Many accidents take place on this highway at Pimpalkhuta. We were called for help and when we went there, we saw the horrible situation...The tyres had fallen apart," the local resident said.

"People inside were trying to break the windows. We saw people getting burnt alive...The fire was so intense that we could not do anything. We were in tears...," he said.

Had the vehicles passing by the highway stopped for help, more lives could have been saved, he added.

Harshad Pathe, the elder brother of 23-year-old Nikhil Pathe from Gondhdi village of Yavatmal, told media that he had dropped his brother at the Vidarbha Travels' boarding point on Friday night.

"My brother was going to Pune to find a job there. But it turned out to be his final journey," he said.

4 Arrested From Haryana For Attacking Bhim Army Chief

Four people were arrested from Haryana's Ambala district on Saturday for their alleged involvement in the attack on Bhim Army chief Chandra Shekhar Aazad, a police official said.

They were arrested in a joint operation by the Haryana and Uttar Pradesh police, Haryana Special Task Force Deputy Superintendent of Police Aman Kumar said.

The four were arrested from the Shahzadpur area in Ambala, police said.

The Dalit leader was injured when unidentified attackers opened fire on his car in Deoband in Uttar Pradesh on June 28.

The four were arrested from the Shahzadpur area in Ambala, Mr Kumar said and added that the accused were identified as Vikas of Haryana and Vikas, Prashant and Lovish of Uttar Pradesh.

Vikas belonged to Gonder village in Haryana's Karnal district while the three others hailed from Rankhandi village in Uttar Pradesh's Saharanpur area, he said.

Mr Kumar said no weapon was seized from them and they were handed over to the Uttar Pradesh Police.

On June 28, Aazad (36) had gone to attend a 'terhavin' ritual at a supporter's home in Saharanpur district's Deoband and the attackers fired "four shots" at his SUV when he was leaving.

Opinion: Opinion: Tamil Nadu Fiasco Shows Why Governors Should Be Abolished

In an unprecedented move, the Tamil Nadu Governor, on his own accord and without the recommendation of the Tamil Nadu Chief Minister, dismissed the cabinet minister V Senthil Balaji. Facing massive political backlash, the Governor seems to have developed cold feet and communicated to the Tamil Nadu government that his earlier decision was on hold. Even still, his unilateral initial decision signifies the normalised weaponization of the office of the Governor, which has become routine under the Modi government and has precipitated a constitutional crisis in yet another opposition-ruled state.

What's wrong with the decision:

1. Illegal: The decision is manifestly illegal as it contravenes Article 164(1), which binds the Governor to appoint/remove ministers on the advice of the Chief Minister, read in conjunction with Article 163, which restricts the Governor's autonomy by abiding him to be guided by the aid and advice of the council of ministers, except in well-defined cases of exception. Different Supreme Court rulings have laid out that the pleasure of the Governor in appointing and removing ministers is not a subjective personal pleasure of the individual holding the Governor's post but rather supervised by the aid and advice of the Chief Minister. By attempting to exercise autonomy in a matter where none is granted by the constitution, the Governor is trying to usurp power illegitimately.

2. Subverts triple chain of accountability: The decision effectively seeks to install the Governor as the boss of ministers. The Governor is now seeking to play judge, jury, and executioner in pending investigations launched, for widely believed petty partisan and political motives, by his appointee entity (the Union Government). Instead of being accountable to the assembly, the council of ministers is now sought to be controlled by an unelected and unaccountable power centre - the Governor.

3. Infringes on the state's autonomy and reduces the rights of the people of the state: The removal also raises the question: Who is the Governor to deny the people of the state the minister they want if he/she meets the constitutional requirements? The Governor, by exceeding the constitutional brief and attempting to personally dictate the makeup of the state executive, violated his most important duty, i.e., to defend the constitution, which envisions a federal structure and accountable government.

What it exemplifies:

The misadventure, sadly, indicates a trend of abuse of the office of the Governor with worrying implications:

1. Governor's office has become a threat to federalism and constitutional propriety: Under the Modi Government, a clear pattern indicates that the Governors and Lieutenant Governors have been mandated to weaken, discredit, destabilise, and disrupt opposition-ruled states. From impeding governance and defeating people's will through sitting on bills in Tamil Nadu to Governors using the megaphone of their post to act as spokespersons of the BJP in opposition-ruled states such as West Bengal, Kerala, and Punjab, to throttling people's voices by preventing the convening of the assembly in Punjab, the instances of Governors violating propriety, precedence, and explicit constitutional provisions and Supreme Court judgments to upend the basic feature of federalism have become a regular and defining aspect of the BJP Government.

2. Helplessness of constitutional safeguards against a malicious central government intent on deploying constitutional offices for fraud and illegality as political tools: The constitution has no accountability mechanism for governors; their appointment as well as removal is totally at the discretion of the central government. Thus, the Governors and Lieutenant Governors exercise power without accountability. In so doing, the constitution makers expected the regime to be governed by constitutional propriety. But when the party in power is devoid of any commitment to constitutional morality, the design of the Governor's office makes it ripe for the band of governors on display presently. Just last month, the Supreme Court itself had seriously castigated the illegal role of the Governor of Maharashtra in calling for a trust vote against the Uddhav government. The Lieutenant Governor of Delhi, meanwhile, each day, perfects the art of disrupting our elected Government in Delhi. The malicious intent of the Central government in misusing the office of Governors and Lieutenant Governors to undermine people's will, destabilise elected governments, and weaken federal units was exemplified in the services ordinance it brought overnight in May to snatch powers vested in the elected Delhi Chief Minister and cabinet by the constitution and the Supreme Court Constitutional and instead vest them in the unelected Lieutenant Governor.

3. The design of the office of the Governor and its very necessity needs a rethink: Ultimately, democracies are about structures of power being justified through public rationality. While the abuse and harm by Governors are well-documented and growing in instances by the day, the question of what good the office of the Governor is doing is shrouded in mystery. The office of the governor, as detailed through the various instances above, has turned into an attack post on the federal structure and representative democracy envisioned in the Constitution. The Raj Bhavans have turned into plotting spaces against elected governments, with newer ways devised daily to assault constitutional propriety. The exorbitant public money spent on maintaining the mischievous offices of Governors can be easily spent better by assigning the limited roles envisioned for the Governor (swearing in new governments, reporting to the centre on the breakdown of constitutional machinery, etc.) to the Chief Justice of the respective High Courts. The Aam Aadmi Party has therefore called for the abolition of the post of Governor. The constitutional breakdown and crisis sparked by the Tami Nadu Governor's abuse of power requires us to carefully contemplate the root cause of the malaise plaguing our body politic and arrive at a consensus on a more sustainable and fundamental solution of abolishing the office of the Governor to prevent more such breakdowns from happening regularly.

Amid Tussle With MK Stalin Tamil Nadu Governor's Praise For PM Modi

Amid the ongoing tussle between Tamil Nadu Chief Minister MK Stalin and Tamil Nadu Governor RN Ravi over the dismissal of V Senthil Balaji as a minister, Governor RN Ravi heaped praise on PM Modi for his vision.

Addressing a gathering, the Governor said, "If you are weak you are surrounded by enemies, if you are strong you have friends. That is the destiny of Bharat. What the PM has set...again a divine mandate is his appearance, he is such a person who understands what is Bharat and the power of its people...He has set a course that he calls 'Amrit Kaal'. In the next 25 years, this country must be capable of spreading the light of Sanatana Dharma to the whole world."

Tamil Nadu Chief Minister on Friday wrote to Governor RN Ravi over the dismissal of Mr Balaji as a minister and stating the (Governor) has "no powers to dismiss my ministers".

"I reiterate that you have no power to dismiss my Ministers. That is the sole prerogative of an elected Chief Minister. Your unconstitutional communication dismissing my Minister without my advice is void ab initio and non-est in law and hence has been disregarded," said MK Stalin in a letter. Referring to the Governor's "breakdown of Constitutional machinery" remark, Mr Stalin said it was an alluded remark. "Only a person convicted attracts disqualification," he wrote.

Senthil Balaji was arrested on June 14 in connection with a cash-for-jobs scam case.

On Thursday, the Tamil Nadu Governor dismissed minister Senthil Balaji due to criminal charges against him. However, the decision was later put on hold, and the Governor said he has to seek advice from the Attorney General.

The former Union minister and Congress leader Manish Tewari slammed the dismissal of the jailed minister, tweeting, "Article 164 of COI" The Chief Minister shall be appointed by the Governor and the other Ministers shall be appointed by the Governor on the advice of the Chief Minister... Since Ministers are appointed on the advice of the Chief Minister they can be removed ONLY on the advice of Chief Minister Unconstitutional Gov."

Aam Aadmi Party (AAP) leader Raghav Chadha on Thursday termed Balaji's removal as "outrightly unconstitutional."

2 Killed In Blast At Illegally-Run Plastic Moulding Factory In Delhi

Two persons died on Saturday after a compressor exploded in an air compressor tank at an illegally-run plastic moulding factory in northeast Delhi's Gokalpuri area, police said.

A PCR call was received at 3.30 pm regarding the blast. It was reported that three persons were injured in the explosion and two of them were shifted to a hospital, they said.

PCR, local police and staff from the fire department immediately reached the spot. They found out that a plastic moulding factory was being run from the house, Deputy Commissioner of Police (northeast) Joy Tirkey said.

Inquiry revealed that four persons were injured at the site. While three of them had already been taken to GTB hospital, the fourth one was found dead at the spot, he said.

Later, one of the injured died at the hospital, the DCP said.

The blast had taken place in the air compressor tank used in the plastic moulding machine. The factory was being operated in a rented accommodation of around 150 square yards, DCP Tirkey said.

Naresh, the owner of the property, had rented the premises to one Yadav, who was running the factory. Efforts are being made to contact both of them. Their mobile phones are switched off. They will be traced soon, the DCP said.

The victims have been identified as Bablu (38), a resident of Rohini Sector-22, and Karan (60). Bablu was a compressor mechanic. He had died on the spot, while Karan lost his life in the hospital during treatment. Further investigation is in progress, police added.
