Bill Over Delhi Services Ordinance To Be Taken Up In Lok Sabha Next Week

Union Minister Arjun Ram Meghwal today said a bill to replace the ordinance introduced for the creation of an authority for transfers and postings of Group-A officers in Delhi will be taken up by Lok Sabha next week.

The Union minister for law and justice was informing the House about the business listed for the coming week.

A number of notices submitted by opposition leaders to move a statutory resolution opposing the controversial ordinance will also be taken up when the Government of National Capital Territory of Delhi (Amendment) Bill is tabled in the House.

The Lok Sabha Secretariat has admitted notices submitted by several opposition leaders including Congress' Adhir Ranjan Chowdhury, TMC's Saugata Roy and DMK's A Raja, NK Premchandran and Dean Kuriakose.

The Union Cabinet on Tuesday gave its nod to the Government of National Capital Territory of Delhi (Amendment) Bill, which will replace the ordinance introduced by the Centre on May 19.

The controversial ordinance was brought into effect a week after the Supreme Court handed over the control of services in Delhi, excluding police, public order and land, to the elected government headed by Chief Minister Arvind Kejriwal.

It facilitated the setting up of a National Capital Civil Service Authority (NCCSA) for the transfer of and disciplinary proceedings against Group-A officers from the DANICS cadre.

Transfer and postings of all officers of the Delhi government were under the executive control of the Lieutenant Governor before the May 11 top court verdict.

Arvind Kejriwal's AAP, which is also a part of the opposition coalition INDIA, has reacted strongly against the ordinance, saying the Centre had "deceived" the people of Delhi.

The Congress and other opposition parties have also come out against the ordinance.

3 Girls Who Shot Video Of Student In Karnataka College Washroom Get Bail

A magistrate court in Udupi on Friday granted conditional bail to three female students accused of taking a video of another student in a college washroom.

A case against the three students and the college management was registered by Malpe police on July 25.

On Friday the students surrendered before the Additional Civil Judge and Judicial Magistrate First Class Court of Judge Shyam Prakash.

"Will Assess Situation, Make Suggestions": Opposition MPs Headed To Manipur

A delegation of 20 INDIA bloc MPs will visit Manipur over the weekend to assess the ground situation first-hand and then make recommendations to the government and Parliament for a solution to the problems in the violence-hit state.

Ahead of the visit, Congress' deputy leader in Lok Sabha Gaurav Gogoi called for an inquiry under a retired Supreme Court judge into the violence in Manipur.

The delegation will include Adhir Ranjan Chowdhury and Gaurav Gogoi of the Congress, TMC's Sushmita Dev, JMM's Mahua Maji, DMK's Kanimozhi, NCP's Mohammad Faizal, Jayant Chaudhary of RLD, Manoj Kumar Jha of RJD, N K Premachandran of Revolutionary Socialist Party and T Thirumavalavan of the Viduthalai Chiruthaigal Katchi.

JDU chief Rajiv Ranjan (Lalan) Singh, Aneel Prasad Hegde (JDU), CPI's Sandosh Kumar, CPI(M)'s AA Rahim, Samajwadi Party's Javed Ali Khan, IUML's E T Mohammed Basheer, AAP's Sushil Gupta, Arvind Sawant (Shiv Sena-Uddhav Thackeray), D Ravikumar (DMK) and Phulo Devi Netam (Congress) will also be part of the delegation.

Mr Gogoi said, "The BJP wants to give the picture that everything is fine in Manipur but it is not so with violence continuing. That is why we want that an inquiry should be conducted under a retired Supreme Court judge as to how did the state government fail, how did people get access to weapons in this quantity, what was the administration doing." 

"The chief minister (N Biren Singh) himself admits that there are more than 100 FIRs. Why was the administration sleeping for two months. There should be an inquiry under a retired Supreme Court judge and all INDIA (Indian National Developmental Inclusive Alliance) MPs will go to Manipur and find out the truth and will put forward that truth before Parliament," he told PTI outside Parliament.

Trinamool Congress' Dev said the opposition delegation wants to give the message that "we are with the people of Manipur".

"We are concerned, we want peace to return...the government has failed, so we want to go there and see what solution can be found," she said.

Dravida Munnetra Kazhagam (DMK) leader T R Baalu said the opposition delegation will be leaving for Manipur Saturday morning and will find out what went wrong, the extent of damage and loss of lives and property.

Revolutionary Socialist Party (RSP) leader Premchandran said the intent of the visit is to get first-hand information about what's happening in the state.

"The violence is still going on so we would like to have first-hand information and suggest some solutions and recommendations to the government and Parliament before the discussion comes there," he said.

"We would like to visit the relief camps regarding rehabilitation of the victims. What is the real cause of the violence, we want to find out," he said.

The opposition bloc had been demanding that a delegation of their leaders be allowed to visit the state but till now they had been denied permission in view of the situation there.

The opposition has been demanding a statement from the Prime Minister in Parliament on the situation in ethnic strife-torn Manipur followed by a full-fledged discussion on it.

The northeastern state of Manipur has been engulfed in ethnic violence since May 3, in which more than 160 people have lost their lives.

In Disciplined Force Like Army, Seniority Is Important: Supreme Court

In a disciplined force like the Indian Army seniority has all the importance, the Supreme Court has said while commuting the life sentence of a non-commissioned officer held guilty for killing his colleague during an altercation over seniority.

On December 4, 2004, the lance naik and the victim, who was also of the same rank, were on duty at Ferozepur cantonment in Punjab where they quarrelled over seniority.

The convict snatched the rifle from the victim and shot him. The single bullet that the victim took proved fatal. He was rushed to a hospital where he was declared dead.

The errant army personnel was convicted by the Court Martial for the offence punishable under Section 302 (murder) of the IPC read with Section 69 of the Army Act, 1950, and was sentenced to imprisonment for life.

The Armed Forces Tribunal, Chandigarh confirmed his conviction and sentence which was upheld by the Punjab and Haryana High Court.

While modifying the conviction and reducing the sentence to nine years and three months that the man had already served, the top court said it appears the appellant snatched a rifle held by the victim in the heat of the moment and fired one bullet.

Had there been any premeditation on the part of the appellant or if he had any intention to kill the victim, he would have fired more bullets, the Supreme Court said.

The bench of Justices Abhay S Oka and Sanjay Karol said there was no intention on his part to kill the victim.

"Both the appellant and the deceased had consumed liquor. There was a fight between him and the deceased over the issue of seniority. In fact, when the appellant told the deceased to bring water for him, the deceased refused to do so on the ground that he was senior to the appellant.

"In a disciplined force like Army, the seniority has all the importance. Therefore, there is every possibility that the dispute over seniority resulted in the appellant doing the act in a heat of passion," the bench said.

The Supreme Court said it is not in dispute that the Lance Naik has undergone incarceration for a period of nine years and approximately three months.

"Taking an overall view of the evidence on record, the sentence already undergone by the appellant will be an appropriate sentence in the facts of the case," it said.

UP Woman Raped By Father-In-Law, Set On Fire For Refusing Dowry. Accused Arrested

A man was arrested in Uttar Pradesh's Balia along with his son for allegedly setting his daughter-in-law on fire over dowry after he raped her, police said today.

Circle Officer Mohammaed Usman said, "We have arrested one Shankar Dayal Chaube and his son Anand Chaube in connection with the dowry death of a 22-year-old wife of Anand Chaube."

According to a police complaint, the two men and their other family members regularly harassed the woman for a dowry of Rs 50,000 and a gold chain.

Upon her refusal on June 25, the two doused the woman with inflammable oil and set her on fire, the police said. She succumbed to burn injuries about a week later, they said.

Before she died, the woman recorded her statement before a magistrate in the hospital.

"In her statement, the woman accused her father-in-law of raping her before she was set on fire. The woman succumbed to her injuries at the hospital on July 3," police said.

Police have filed an FIR against the accused under sections of IPC at Bairiya Police Station. The matter is still under investigation.
