Supreme Court's Pushback To Centre Took 4 Days Of Discussion: Sources

The Supreme Court's unprecedented step of making public its communication with the Centre on judges' elevation was taken after four days of deliberation, sources have told NDTV. Chief Justice of India DY Chandrachud had conferred not only with brother judges of the Collegium, but also the judge who is expected to succeed him, sources said.  

There has been no response yet from the government, which is trying to have a bigger role in judges' appointment. The back and forth, on for years, has escalated into a full-blown legislature versus judiciary debate.  

In the three letters uploaded today, the court has revealed the reasons for objections of the Centre and the intelligence agencies and its own response to it.

Sources said in a series of meetings over the last four days, the judges decided to bring the entire issue before the public. It was also decided that the Collegium will re-recommend the elevation of lawyers Saurabh Kirpal, Somasekhar Sundaresan and R John Sathyan.   

On Wednesday, the three judges who signed the letters -- Chief Justice DY Chandrachud and Justices SK Kaul and KM Joseph -- had a meeting. A follow-up meeting was held this morning before the letters were uploaded on the Supreme Court website.

The recommendation to elevate the three candidates to the Delhi, Bombay and Madras High Courts got a thumbs down from the Centre in November. The top court revealed that the Centre's objections in case of Saurabh Kirpal was about his sexual orientation and the foreign nationality of his partner.  

The other two candidates -- Somasekhar Sundaresan and R John Sathyan -- were rejected because of their social media posts. One of them, Mr Sathyan, shared an article critical of Prime Minister Narendra Modi, among other things. The other, sources said, expressed contrary opinions about the Citizenship Amendment Act.  

The top court's move comes a week after the strong remarks of Vice President and Rajya Sabha chairman Jagdeep Dhankhar, who so far had been vocal about the scrapping of the National Judicial Appointments Act.  

This time, Mr Dhankhar had questioned the historic 1973 Supreme Court judgment on the Kesavananda Bharati case and the resulting basic structure doctrine on the Constitution. "Today this one-upmanship and public posturing from judicial platforms are not good. These institutions must know how to conduct themselves," he had said.  

The debate on executive versus judiciary has spiked over the issue of judicial appointments, where the government is pushing for a bigger role. Over the last years, the government has repeatedly objected to names chosen for elevation by the Supreme Court. In November, it returned the names of 19 candidates -- a list that included the three lawyers from Delhi, Bombay and Madras High Courts.   

There has been pushback from the top court, which said the Collegium system is the "law of the land" which should be "followed to the teeth" till another law comes in and survives constitutional scrutiny. A bench headed by Justice SK Kaul had also asked the Attorney General to advise constitutional authorities to refrain from making statements on the Collegium system.

"Going Back To My Roots": Rahul Gandhi As Yatra Enters Jammu And Kashmir

Entering Jammu and Kashmir on the last leg of his Bharat Jodo Yatra, Congress leader Rahul Gandhi accused the Centre of indulging in mass pickpocketing by diverting the attention of people and then looting them.

Addressing a rally here, the former Congress president said he had walked from Kanyakumari to Kashmir and talked to thousands of people.

As dusk fell and temperatures dipped, hundreds of people walked alongside Gandhi. In a customary handover function, Punjab's Congress unit gave the party flag to a leader from the Jammu and Kashmir wing.

"The BJP and RSS have spread hatred. I earlier thought it ran deep but it does not and is mainly seen on television," Mr Gandhi said in his first stop in Jammu and Kashmir, about 90 km from Jammu.

He listed hatred, violence, unemployment and price rise as the main issues confronting the country and blamed the media for not highlighting them.

Criticising the media for not focusing on the right issues, he said it uses topics such as Bollywood stars Aishwarya Rai and Akshay Kumar to divert the attention of people.

There was one more point about two India's in making - one for poor and one for the corporate world, he said.

Injecting a personal note, Mr Gandhi said his ancestors belonged to this land and he felt he was returning home. "I am going back to my roots, I know the suffering of the people of Jammu and Kashmir and come to you with a bowed head," he said.

Mr Gandhi said he had been walking about seven hours a day, covering 25 km each day, but nobody was tired as some people had predicted. "I later felt we are not feeling tired because people are pushing us forward." "If someone falls, he is supported within seconds... nobody is asking anyone what is your religion," he said.

Mr Gandhi started walking from Kanyakumari in September. The Bharat Jodo Yatra is scheduled to conclude in Srinagar on January 30. The distance yet to be covered is over 360 km.

Earlier welcoming him, National Conference chief Farooq Abdullah drew a parallel between the Shankaracharya and Rahul Gandhi. "Many years ago, Shankaracharya had undertaken a yatra from Kanyakumari to Kashmir. And today you are doing it," the MP said here.

He said that today's India is not that of Ram's Bharat or Gandhi's Hindustan because people are divided on religion. "If we are together, we will be able to overcome the hatred of the present day," he said.

Mr Abdullah, who made his second appearance in the yatra, made an passionate wish saying "before I close my eyes, I want to see my secular Hindustan again where everyone is respected." Amid chants of "Nafrat Chodo Bharat Jodo" (Leave hatred and unite India), Mr Gandhi led Bharat Jodo Yatra yatra entered this Jammu and Kashmir via Pathankot-Punjab, marking the final phase of the 3500-km foot March by the Congress leader started from Kanyakumari in September.

Mr Gandhi was welcomed into union territory by senior party leaders including Jairam Ramesh, Ashok Gehlot, Digvijay Singh, Abdullah, Shiv Sena leader Sanjay Raut, Dogra Swabhiman Sangathan Party and former minister Lal Singh, Awami National Conference leader Muzaffar Shah.

Mr Lal Singh was not present at the podium as he came late and was seen standing in the crowd throughout the function. While thanking the leaders who turned up, the Congress did not mention the name of Mr Lal Singh.

Fire crackers were burst as Mr Gandhi accompanied by party workers and supporters crossed the Madhopur bridge into Jammu and Kashmir amid tight security cover.

The venue near the statue of Maharaja Gulab Singh was jam-packed with thousands of people turned up to witness the event.

"After covering 3200 km from Kanyakumari, it is a happy moment for us that the yatra has reached Jammu and Kashmir," Jammu and Kashmir Pradesh Congress committee president Vikar Rasool Wani said.

Polar Bear Kills Woman, Boy In Remote US Village

In a rare attack on humans, a polar bear killed a woman and a boy in a remote area of Alaska, police said. However, the bear was later shot and killed by a resident in the tiny community of Wales, on the far western coast of Alaska.

"Initial reports indicate that a polar bear had entered the community and had chased multiple residents," police said in a statement.

"The bear fatally attacked an adult female and juvenile male -- it was shot and killed by a local resident as it attacked the pair," police said, adding that state troopers and Fish and Game Department authorities were trying to reach the town "as weather conditions allow."

The victims' identities were not made public as authorities were trying to notify their families, AFP reported.

Polar bear attacks are extremely rare, with local media reporting one of the most recent fatal encounters between a human and a polar bear in Alaska was in 1990.

According to Canadian NGO Polar Bears International, only 20 people worldwide are known to have been killed by polar bears between 1870 and 2014, though the frequency of attacks is increasing.

Wales, a village of about 150 people on the Bering Strait that separates the United States from Russia, is part of the Alaska Nannut Co-Management Council, a group of Indigenous communities that have traditionally hunted polar bears for subsistence.

The giant bears -- males can grow up to 1,500 pounds (680 kilograms) -- face increasing threats from climate change, with their Arctic sea ice habitat disappearing as the far north warms up to four times faster than the rest of the world.

The bears, whose populations are declining, rely on the ice for foraging for seals and for movement and reproduction.

Some Arctic communities employ polar bear patrols to protect residents from the animals, though one was not currently in operation in Wales, according to the Anchorage Daily News.

Republic Day Parade: 32,000 Tickets On Sale, All Official Invites Online

The Republic Day celebrations this year will take place on the revamped Central Vista avenue, and the government has put 32,000 tickets on sale online for the masses, defence ministry officials said on Wednesday.

For the first time, all official invites for the ceremonial event will be sent online, they said. This will be the first Republic Day celebrations hosted at the ceremonial boulevard after Rajpath was renamed to 'Kartavya Path' last year.

A presentation on the celebrations to be held from January 23-31 as part of the Republic Day celebrations was made on Wednesday after a press briefing by Defence Secretary Giridhar Aramane at the South Block here.

The Republic Day celebrations will be held in a spirit of greater 'janbhagdari' (public participation) and workers of Central Vista project and their family members, maintenance workers of Kartavya Path, vegetable vendors, milk booth workers, grocery shopkeepers and rickshaw-pullers will be "special invitees", the officials shared during the presentation.

"Before COVID-19, over a lakh people used to attend the Republic Day celebrations, which was drastically cut in the immediate years following the outbreak of the pandemic in India (in early 2020). This year about 42,000 people are expected to attend it and 32,000 tickets for seats at the event have been put online, and the response from people have been good," the senior official said. New bleachers and retractable seats have been put up in the lawns of the Kartavya Path, and with more space between two seats, he said.

The celebrations will begin with a grand event on the birth anniversary of Netaji Subhas Chandra Bose on January 23 and go on till Gandhi Jayanti, the defence secretary said.

A military contingent from Egypt will also be taking part in the celebrations, officials said.

Hundreds Of London Cops Likely To Be Sacked For Sexual Offences: Report

Hundreds of officers in London are likely be sacked for sexual and domestic abuse offences, Britain's most senior policeman said on Tuesday as he sought to regain public trust after an officer admitted being a serial rapist.

London's Metropolitan Police ("the Met"), which has been rocked by scandals in recent years, was plunged into further crisis after David Carrick, 48, admitted carrying out 24 counts of rape over almost two decades while serving as a police officer while his colleagues missed chances to stop him.

The case follows a series of revelations of serious wrongdoing at the force, Britain's biggest with more than 43,000 officers and staff and responsibility for leading the country's response to terrorism and issues such as extradition.

London Commissioner Mark Rowley, brought in four months ago to lead the clean-up, said investigations were underway into about 800 officers over 1,000 sexual and domestic abuse claims. Many jobs will be lost as part of the process, he said.

"I've got tens of thousands of fantastic men and women, but I've got hundreds who shouldn't be here. I'm going to sort it out," Mr Rowley told the BBC on Tuesday.

"We're systematically reviewing every member of police staff and police officer who we have any historic flags against, for being involved in incidents involving domestic abuse or sexual violence."

Corruption, racism and misogyny

Public confidence in the Met has been hit by revelations of its culture of corruption, racism and misogyny.

In recent years, one officer was jailed for the rape and murder of a woman he abducted as she walked home and the courts then ruled heavy-handed policing at a vigil in her honour was unlawful.

A serving officer was convicted of being a member of a neo-Nazi group, two more were jailed for sharing pictures from a crime scene after the murder of two sisters, while an inquiry into one unit found discussions about beating women, with one officer messaging a female colleague to say he would rape her.

The Met has been the subject of an independent review since 2021, with initial findings concluding "radical" reform was needed in relation to dealing with allegations of misconduct against officers.

The case of Carrick, one of Britain's most prolific sex offenders who pleaded guilty to 24 counts of rape between 2003 and 2020, prompted questions about the failure to spot what he was doing.

He had previously come to police attention over nine incidents including accusations of harassment, assault and rape between 2000 and 2021 but was not charged with any offence.

Carrick had used his position of power to control and intimidate his victims, telling them no one would believe their word against that of a serving officer.
