Twitter Faces Lawsuit Over Unpaid Bills In Four Countries

Elon Musk's Twitter is facing another lawsuit after the company was unable to pay for services for offices in London, Dublin, Sydney and Singapore, according to a Guardian report.

The Australian firm's lawsuit is the latest alleging non-payment of bills and rent against Twitter. Facilitate said from 2022 through early 2023, it installed sensors in Twitter's offices in London and Dublin, completed an office fit-out in Singapore, and cleared an office in Sydney, Reuters reported.

Facilitate is seeking a collective payment of over A$1m ($666,000) across the three businesses.

The company has now decommissioned Twitter's Sydney office and temporarily stored its contents, according to case documents obtained by the Guardian.

The company claims Twitter owed about 203,000 pounds, S$546,600 and A$61,300, respectively.

The case is filed in the US district court of Northern California at the end of June.

Facilitate said it was seeking compensatory damages in an amount to be determined at trial, legal costs and interest at the maximum legal rate.

However, Twitter has not yet filed a defence.

In the court filings, the company said that it is not the sole company suing Twitter since Musk took over. The firm said that Musk's moderation decisions and the unbanning of far-right and neo-Nazi accounts had alienated advertisers and caused a financial crisis for the company.

"Twitter responded with a campaign of extreme belt-tightening that amounted to requiring nearly everyone to whom it owes money to sue," the firm said.

"Twitter stopped paying rent on some of its offices and stopped paying several vendors whose services it was still using. Twitter also cancelled many contracts and stopped paying people to whom it owes money."

In May, a former public relations firm filed a suit in a New York court saying Twitter had not paid its bills, while early this year U.S.-based advisory firm Innisfree M&A Inc sued it, seeking about $1.9 million for what it said were unpaid bills after it advised Twitter on its acquisition by Musk.

Britain's Crown Estate, an independent commercial business that manages the property portfolio belonging to the monarchy, in January, began court proceedings over alleged unpaid rent on Twitter's London headquarters.

Donations To French Cop Top Aid Received By Family Of Teen He Shot Dead

A collection for a French policeman who sparked nationwide riots last week by shooting a teenager dead reached more than 986,000 euros ($1.07 million) on Monday, dwarfing donations to the victim's family.

More than 40,000 people have pledged money to the online fund for the officer, set up on the website Gofundme.com by a far-right media commentator.

The collection easily outstripped the 189,000 euros gathered for the family of the dead 17-year-old, Nahel, who is of north African origin and lived with his mother on a housing estate in a west Paris suburb.

Nahel's grandmother said she was "heartbroken" by the support shown for the policeman.

"He took the life of my grandson. This man must pay, the same as everyone," she told the BFM channel on Sunday.

"I have confidence in the justice system. I believe in justice."

The shooting, during a traffic stop, has exposed deep political divisions in France.

Many right-wing figures are seeking to defend the security forces, while those on the left see the death as a consequence of systemic racism in the police.

'Doing his work'

Widespread rioting and looting since Tuesday appear to have deepened the polarisation.

Politicians from the centrist ruling party and on the left have condemned the collection for the policeman, which was launched by far-right commentator Jean Messiha -- himself close to anti-Islam politician Eric Zemmour.

"Jean Messiha is playing with fire," ruling party MP Eric Bothorel wrote on Twitter, calling it "indecent and scandalous".

The head of the Socialist party, Olivier Faure, addressed a message to Gofundme, saying they were facilitating a "shameful" collection.

Senior hard-left MP Mathilde Panot highlighted how a collection for a former boxer who had punched several police officers during "Yellow Vest" anti-government demonstrations in 2019 had been quickly closed by authorities.

"Killing a young North African, in France in 2023, can earn you a lot of money," she wrote.

Jean Messiha, a commentator on the right-wing CNews channel and former advisor to far-right leader Marine Le Pen, celebrated on Twitter when his fund overtook the one for the family of Nahel at the weekend.

When launching the collection, he said it was for an officer who was "doing his work and is paying a heavy price".

'Not in line with rules'

The head of the right-wing Republicans party, Eric Ciotti, defended the initiative on Monday and said he might contribute.

The officer's family was "facing difficulties", he said.

The 38-year-old policeman, named in French media as Florian M., has been detained and charged with voluntary manslaughter.

In a video of the shooting, he can be seen with a colleague stopping a yellow Mercedes which Nahel was driving without a licence in the western Paris suburb of Nanterre on Tuesday morning.

The officer has his weapon drawn and shoots Nahel at point-blank range as the car drives off.

Prime Minister Elisabeth Borne said the operation was "was obviously not in line with the rules of engagement for police".

Florien M. also faces charges of making false statements, having initially claimed that he opened fire when Nahel drove towards him.

Another teenager in the car told media after the incident that the officers had hit Nahel with the butts of their guns before opening fire.

A voice can be heard on the video saying: "You are going to get a bullet in the head."

Lt Governor Ends Services Of 400 Specialists Working With Delhi Government

Lt Governor V K Saxena terminated the services of around 400 'specialists' appointed by the AAP government in different departments, officials said on Monday, a decision that could trigger a fresh round of confrontation between the ruling party and the LG.

They were engaged in a "non-transparent manner" and without the mandatory approvals of the competent authority, the LG office said in a statement.

The appointments also did not follow the mandatory reservation policy for SC, ST and OBC candidates prescribed by the Department of Personnel and Training, it added. No immediate reaction was available from the Kejriwal government.

"Delhi LG, VK Saxena has agreed to the proposal of the Services department to immediately terminate the services of about 400 private persons engaged as Fellows/Associate Fellows/Advisors / Dy Advisors/Specialists/Senior Research Officers/Consultants, etc by Delhi government in its various departments and agencies," the LG office statement said.

Why BJP Wanted Ajit Pawar: NCP Leader's Warning For Eknath Shinde

Sharad Pawar's Nationalist Congress Party -- caught unawares by his nephew Ajit Pawar's abrupt crossover to the ruling alliance -- today declared that it is not good news for Chief Minister Eknath Shinde. The BJP's aim, the party hinted, was to look for a replacement for Mr Shinde, whose partnership with Devendra Fadnavis is said to have hit too many bumps.

"Eknath Shinde's power will be reduced," said senior NCP leader Jayant Patil, who spelt out the party's stand regarding Ajit Pawar's claims of the whole party supporting his crossover, at a press conference this evening.

As reason, he claimed that "some people" did not like the way the Chief Minister works.

"Now to reduce his (Eknath Shinde's) importance, Ajit Pawar has been added in the government that's already in majority," Mr Patil said.

While the BJP allowed Mr Shinde to head the government, there has been friction. Leaders of Mr Shinde's faction have claimed that the BJP has been trying to play the big brother.

There have been reports that the BJP wants 10 ministers from the Shinde cation dropped ahead of the coming reshuffle of the state cabinet to make space for the NCP ministers.

In April, Mr Shinde's faction had said if Ajit Pawar joined the alliance with other leaders of NCP, they will quit being part of the government.  The matter was said to have been sorted with the intervention of Union Minister and the BJP's chief strategist Amit Shah, who met both Mr Shinde and Ajit Pawar in Delhi last week.

Today, Mr Shinde had warm words of welcome for the NCP leader.

"Now the double engine government has a triple engine. The state will sprint (on the path of development). Now we have one Chief Minister and two deputy chief ministers. This will help faster development of the state," he said.

The BJP has not commented on the matter. Sources in the party said Ajit Pawar's decision to extend support to the alliance government is a result of Congress trying to foist Rahul Gandhi as the leader of Opposition and PM candidate for 2024.

"Rahul Gandhi and the Congress's high handedness is the reason for NCP breaking ranks," a leader said.

Pak Taliban Kill 4 Cops In Sunday Shootout In Balochistan

Four security officers were killed in a shootout in Pakistan's southwestern Balochistan province on Sunday, officials said, in an attack claimed by the Pakistan Taliban.

About a dozen gunmen attacked policemen and paramilitary Frontier Constabulary officers at a highway checkpoint in Zhob district, prompting a two-hour gunbattle.

"Four of the security officials, including three policemen and one Frontier Corps officer, were killed in the attack. One of the suspected attackers has also been killed but not yet identified," Zhob's commissioner, Saeed Umrani, told AFP.

Three others were wounded, officials said.

The Tehreek-e-Taliban Pakistan (TTP) later claimed the attack in a statement, identifying the attacker shot dead by police.

The TTP is separate from Afghanistan's Taliban but shares a similar ideology.

Attacks, mostly targeting security forces, have been on the rise again since the Afghan Taliban seized control in Kabul in 2021 and a shaky months-long ceasefire between the TTP and Islamabad ended in November last year.

The assaults have been regular in regions abutting Afghanistan and Islamabad alleges some are being planned on Afghan soil.

Four policemen in Kuchlak, Balochistan, were killed in April in a gunbattle with terrorists identified by police as being from the Pakistan Taliban.

In January, a suicide bomber linked to the TTP blew himself up in a mosque inside a police compound in the northwestern city of Peshawar, killing more than 80 officers.

Rahul Gandhi Mallikarjun Kharge Extend Support To Sharad Pawar

Congress president Mallikarjun Kharge and party leader Rahul Gandhi spoke with NCP chief Sharad Pawar on Sunday and extended support to him, after the Maharashtra strongman faced a revolt by his nephew Ajit Pawar who along with eight other leaders joined the Eknath Shinde-led government.

The Congress said that the BJP's "washing machine" has resumed its operations as a number of these leaders had been facing serious corruption charges and have now got a "clean chit".

In a surprising move, Ajit Pawar took oath as the deputy chief minister, while eight legislators of his Nationalist Congress Party (NCP) took oath as ministers in the government led by the Shiv Sena and the Bharatiya Janata Party (BJP) earlier in the day.

Congress president Kharge and Mr Gandhi spoke with NCP president Sharad Pawar and extended support to him, AICC general secretary K C Venugopal said on Twitter.

"The BJP's dirty tricks department is working on overdrive in Maharashtra. This is not a legitimately elected government, but an ED-facilitated power grab. The Maharashtra government is a product of corruption and sin," Mr Venugopal alleged.

"The people have very well identified the traitors, corrupt and compromised leaders of Maharashtra and each of them will be taught the lessons of their lifetime in the next elections," he said.

On June 29, PM Modi had spoken about corruption and it appears he switched on the "washing machine" and these leaders are now squeaky clean after this oath-taking ceremony, Mr Venugopal said.

Reacting to the development, Congress general secretary Jairam Ramesh said, "Clearly the BJP's Washing Machine has resumed its operations. A number of new entrants into the BJP-led alliance in Maharashtra today had been facing serious corruption charges with ED, CBI and Income Tax authorities after them. Now they have all got a clean chit." 

The Congress will intensify its efforts to free Maharashtra from the clutches of the BJP, Mr Ramesh asserted.

The Congress is part of the Maha Vikas Aghadi alliance consisting of itself, Shiv Sena (Uddhav Thackeray) and the NCP.

US Teen Sentenced To Up To 40 Years In Prison For Sexually Assaulting Strangling Teacher

A Las Vegas teenager has been sentenced to between 16 and 40 years in prison by Clark County District Court Judge Kathleen Delaney after he strangled and sexually assaulted his teacher while asking about his grades after class.

"It is the most heinous type of crime there could be," the judge told him, inveighing against the attack on the educator, in comments reported by Las Vegas-based CBS affiliate KLAS.

Jonathan Eluterio Martinez Garcia, 17, pleaded guilty to attempted murder, attempted sexual assault, and battery with a deadly weapon resulting in serious bodily harm. He originally faced a dozen charges in the attack on his teacher during a discussion about grades at Eldorado High School, reported Fox News.

On Wednesday, Garcia apologised in court. His lawyer told the judge that his client's behaviour was caused by severe side effects of an asthma medication he took that caused mood changes, night terrors and hallucinations, the Las Vegas Review-Journal reported.

"I regret what I've done," Garcia said. "I also regret the things I should have done, but didn't do." His attorney asked for probation.

In April 2022, a student attacked the teacher in a classroom. He choked her with a string and then slammed her head against the table and knocked her unconscious. While attacking, he allegedly said he "didn't like the teacher" so he was "getting revenge."

When she awoke again she found her pants and underwear had been pulled down and the boy was pouring liquid over her.

The teacher told police that the accused was going to "set something on fire" before toppling a heavy bookshelf over her and sitting down on top of it.

While she was trapped under the shelves, the accused also tried to slash Sade's (the teacher) wrist while he asked, "Can't you die already?"

The accused said that he blacked out during the attack, but he later told police that he raped her and remembered trying to strangle her.

"Came Out By Breaking Windows": Maharashtra Bus Crash Survivors

Some of the survivors of the ill-fated bus that caught fire and led to the death of 25 passengers in Maharashtra's Buldhana district on Saturday, said they managed to come out of the burning vehicle by breaking its window.

The private sleeper coach bus, which was travelling from Nagpur to Pune, met with an accident at Pimpalkhuta village near Sindkhedraja on the Samruddhi Expressway as it rammed into a road divider around 1.30 am on Saturday. Of the 33 passengers travelling on the bus, 25 were charred to death, police said.

Eight others, including the bus driver and its cleaner, survived, they said.

After hitting the divider, the bus overturned and fell on its right side with the entry/exit door facing the sky, they said.

"A tyre of the bus burst and the vehicle caught fire immediately. The blaze spread in no time," one of the survivors said.

"The passenger sitting next to me and I managed to escape by breaking the rear window," he said.

The survivor said that after the accident, teams of police and fire brigade reached the site quickly.

Another survivor, Ayush Ghatge, said it was a miracle that he survived the horrific accident.

He said he boarded the bus at Butibori, an industrial suburb of Nagpur.

"I was on the last seat and sleeping when the accident took place. I woke up when a few people fell on me following the accident. I immediately stood up and started looking for a window to come out. I started breaking a window and three of us came out with each other's help," Ghatge said.

Relatives of Avani Pohnekar, who died in the accident, told a TV channel that she was an IT engineer on way to Pune to explore job opportunities.

"She was going to Pune from Wardha. We later found out that Avani was among the 14 passengers who had boarded this bus from Wardha," they said.

A local resident said four to five passengers managed to escape by breaking one window of the bus.

"But not everyone could do it," he said.

The people who could come out of the bus later told us that they sought help from other vehicles on the highway, but nobody stopped, he added.

"Many accidents take place on this highway at Pimpalkhuta. We were called for help and when we went there, we saw the horrible situation...The tyres had fallen apart," the local resident said.

"People inside were trying to break the windows. We saw people getting burnt alive...The fire was so intense that we could not do anything. We were in tears...," he said.

Had the vehicles passing by the highway stopped for help, more lives could have been saved, he added.

Harshad Pathe, the elder brother of 23-year-old Nikhil Pathe from Gondhdi village of Yavatmal, told media that he had dropped his brother at the Vidarbha Travels' boarding point on Friday night.

"My brother was going to Pune to find a job there. But it turned out to be his final journey," he said.

4 Arrested From Haryana For Attacking Bhim Army Chief

Four people were arrested from Haryana's Ambala district on Saturday for their alleged involvement in the attack on Bhim Army chief Chandra Shekhar Aazad, a police official said.

They were arrested in a joint operation by the Haryana and Uttar Pradesh police, Haryana Special Task Force Deputy Superintendent of Police Aman Kumar said.

The four were arrested from the Shahzadpur area in Ambala, police said.

The Dalit leader was injured when unidentified attackers opened fire on his car in Deoband in Uttar Pradesh on June 28.

The four were arrested from the Shahzadpur area in Ambala, Mr Kumar said and added that the accused were identified as Vikas of Haryana and Vikas, Prashant and Lovish of Uttar Pradesh.

Vikas belonged to Gonder village in Haryana's Karnal district while the three others hailed from Rankhandi village in Uttar Pradesh's Saharanpur area, he said.

Mr Kumar said no weapon was seized from them and they were handed over to the Uttar Pradesh Police.

On June 28, Aazad (36) had gone to attend a 'terhavin' ritual at a supporter's home in Saharanpur district's Deoband and the attackers fired "four shots" at his SUV when he was leaving.

Opinion: Opinion: Tamil Nadu Fiasco Shows Why Governors Should Be Abolished

In an unprecedented move, the Tamil Nadu Governor, on his own accord and without the recommendation of the Tamil Nadu Chief Minister, dismissed the cabinet minister V Senthil Balaji. Facing massive political backlash, the Governor seems to have developed cold feet and communicated to the Tamil Nadu government that his earlier decision was on hold. Even still, his unilateral initial decision signifies the normalised weaponization of the office of the Governor, which has become routine under the Modi government and has precipitated a constitutional crisis in yet another opposition-ruled state.

What's wrong with the decision:

1. Illegal: The decision is manifestly illegal as it contravenes Article 164(1), which binds the Governor to appoint/remove ministers on the advice of the Chief Minister, read in conjunction with Article 163, which restricts the Governor's autonomy by abiding him to be guided by the aid and advice of the council of ministers, except in well-defined cases of exception. Different Supreme Court rulings have laid out that the pleasure of the Governor in appointing and removing ministers is not a subjective personal pleasure of the individual holding the Governor's post but rather supervised by the aid and advice of the Chief Minister. By attempting to exercise autonomy in a matter where none is granted by the constitution, the Governor is trying to usurp power illegitimately.

2. Subverts triple chain of accountability: The decision effectively seeks to install the Governor as the boss of ministers. The Governor is now seeking to play judge, jury, and executioner in pending investigations launched, for widely believed petty partisan and political motives, by his appointee entity (the Union Government). Instead of being accountable to the assembly, the council of ministers is now sought to be controlled by an unelected and unaccountable power centre - the Governor.

3. Infringes on the state's autonomy and reduces the rights of the people of the state: The removal also raises the question: Who is the Governor to deny the people of the state the minister they want if he/she meets the constitutional requirements? The Governor, by exceeding the constitutional brief and attempting to personally dictate the makeup of the state executive, violated his most important duty, i.e., to defend the constitution, which envisions a federal structure and accountable government.

What it exemplifies:

The misadventure, sadly, indicates a trend of abuse of the office of the Governor with worrying implications:

1. Governor's office has become a threat to federalism and constitutional propriety: Under the Modi Government, a clear pattern indicates that the Governors and Lieutenant Governors have been mandated to weaken, discredit, destabilise, and disrupt opposition-ruled states. From impeding governance and defeating people's will through sitting on bills in Tamil Nadu to Governors using the megaphone of their post to act as spokespersons of the BJP in opposition-ruled states such as West Bengal, Kerala, and Punjab, to throttling people's voices by preventing the convening of the assembly in Punjab, the instances of Governors violating propriety, precedence, and explicit constitutional provisions and Supreme Court judgments to upend the basic feature of federalism have become a regular and defining aspect of the BJP Government.

2. Helplessness of constitutional safeguards against a malicious central government intent on deploying constitutional offices for fraud and illegality as political tools: The constitution has no accountability mechanism for governors; their appointment as well as removal is totally at the discretion of the central government. Thus, the Governors and Lieutenant Governors exercise power without accountability. In so doing, the constitution makers expected the regime to be governed by constitutional propriety. But when the party in power is devoid of any commitment to constitutional morality, the design of the Governor's office makes it ripe for the band of governors on display presently. Just last month, the Supreme Court itself had seriously castigated the illegal role of the Governor of Maharashtra in calling for a trust vote against the Uddhav government. The Lieutenant Governor of Delhi, meanwhile, each day, perfects the art of disrupting our elected Government in Delhi. The malicious intent of the Central government in misusing the office of Governors and Lieutenant Governors to undermine people's will, destabilise elected governments, and weaken federal units was exemplified in the services ordinance it brought overnight in May to snatch powers vested in the elected Delhi Chief Minister and cabinet by the constitution and the Supreme Court Constitutional and instead vest them in the unelected Lieutenant Governor.

3. The design of the office of the Governor and its very necessity needs a rethink: Ultimately, democracies are about structures of power being justified through public rationality. While the abuse and harm by Governors are well-documented and growing in instances by the day, the question of what good the office of the Governor is doing is shrouded in mystery. The office of the governor, as detailed through the various instances above, has turned into an attack post on the federal structure and representative democracy envisioned in the Constitution. The Raj Bhavans have turned into plotting spaces against elected governments, with newer ways devised daily to assault constitutional propriety. The exorbitant public money spent on maintaining the mischievous offices of Governors can be easily spent better by assigning the limited roles envisioned for the Governor (swearing in new governments, reporting to the centre on the breakdown of constitutional machinery, etc.) to the Chief Justice of the respective High Courts. The Aam Aadmi Party has therefore called for the abolition of the post of Governor. The constitutional breakdown and crisis sparked by the Tami Nadu Governor's abuse of power requires us to carefully contemplate the root cause of the malaise plaguing our body politic and arrive at a consensus on a more sustainable and fundamental solution of abolishing the office of the Governor to prevent more such breakdowns from happening regularly.
