Cruelty For Woman And Man May Differ: Supreme Court On Divorce Case

What is cruelty for a woman in a given case may not be cruelty for a man, and a relatively more elastic and broad approach is required when a court examines a case in which a wife seeks divorce, the Supreme Court has said while granting a decree of divorce to a woman.

A bench of Justices Sanjiv Khanna and MM Sundresh said the word 'cruelty' under Section 13(1)(ia) of the Hindu Marriage Act of 1955 has no fixed meaning, and therefore, gives a very wide discretion to the Court to apply it "liberally and contextually".

Section 13(1) and 13(1A) of the Hindu Marriage Act, 1955 provide for various grounds for granting divorce including cruelty.

What is cruelty in one case may not be the same for another and it has to be applied from person to person while taking note of the attending circumstances, the bench said. "Therefore, what is cruelty for a woman in a given case may not be cruelty for a man, and a relatively more elastic and broad approach is required when we examine a case in which a wife seeks divorce. Section 13(1) of the Act of 1955 sets contours and rigours for grant of divorce at the instance of both the parties," the bench said.

The bench, which pronounced the verdict on Wednesday, took note of the submission by advocate Dushant Parashar, appearing for the estranged wife, seeking divorce on ground of cruelty and claiming her husband had cast aspersions on her character.

Mr Parashar contended that both the high court and the trial court had erred in refusing to grant divorce.

The bench said the facts of the case spoke for themselves. The couple had got married in the year 2002. It ran into rough weather after the birth of their child. Disputes started between the parties from 2006.

"The appellant-wife registered a complaint under Section 498A of Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. The respondent-husband had questioned the character of the appellant-wife," the bench noted.

The bench noted the husband claimed it was his wife who had left the matrimonial home and also demanded a medical examination of the wife, alleging she was living in adultery and had given birth to a child during the period of non-cohabitation.

The request was rejected by the high court, the bench said, adding the couple has been living separately for a decade and half.

"As fairly stated at the Bar, the marriage does not survive any longer, and the relationship was terminated otherwise except by a formal decree of divorce. The status quo continues, awaiting an approval from this Court," the bench said, adding the facts would certainly make out a case for divorce.

It said the trial court and the high court adopted a "hyper-technical and pedantic approach" in declining the decree of divorce.

"It is not as if the respondent-husband is willing to live with the appellant-wife. The allegations made by him against her are as serious as the allegations made by her against him. Both the parties have moved away and settled in their respective lives. There is no need to continue the agony of a mere status without them living together," the bench said, and granted the decree of divorce to the wife while setting set aside the order of the trial court and the Chhattisgarh High Court.

It said courts must adopt an empathetic and contextual construction of the facts to avert the possibility of perpetuating trauma- mental and sometimes even physical- on the vulnerable party.

"It is needless to say that the courts will be guided by the principles of equity and may consider balancing the rights of the parties. The court, while applying these provisions, must adopt 'social-context thinking', cognisant of the social and economic realities, as well as the status and background of the parties," Justice Sundresh, who wrote the verdict on behalf of the bench, said.

The top court said courts must also keep in mind that the home which is meant to be a happy and loveable place to live, becomes a source of misery and agony where the partners fight.

"When there are children they become direct victims of the said fights, though they may practically have no role in the breakdown of marriage. They suffer irreparable harm, especially when the couple at loggerheads remain unmindful and unconcerned about the psychological and mental impact it has on her/him," it said.

Climate Change Driving Heatwaves, Worsening Air Quality: United Nations

Climate change is driving more intense and more frequent heatwaves, which in turn generate a "witch's brew" of pollutants, threatening the health of humans and other living things, the United Nations warned Wednesday.

The wildfire smoke recently suffocating cities from Athens to New York may be the most visible sign of air pollution brought on by heat waves.

But extreme heat can also induce a whole host of other chemical processes that are hazardous for human health, the United Nations' World Meteorological Organisation said in its annual Air Quality and Climate Bulletin.

"Heatwaves worsen air quality, with knock-on effects on human health, ecosystems, agriculture and indeed our daily lives," WMO chief Petteri Taalas said in a statement.

A recent study by the Energy Policy Institute at the University of Chicago (EPIC) indicated that fine particulate air pollution from vehicles and industrial emissions but also sand and wildfires, is "the greatest external threat to public health" worldwide.

Petteri Taalas stressed that "climate change and air quality cannot be treated separately". 

"They go hand-in-hand and must be tackled together to break this vicious cycle." 

- 'More extreme' -

While Wednesday's report was based on 2022 data, Petteri Taalas cautioned that in terms of temperatures, "what we are witnessing in 2023 is even more extreme".

On Wednesday, the European Union's Copernicus Climate Change Service said the Earth had just had its hottest three months on record, with last July the hottest month ever recorded, followed by August and that 2023 was on track to become the hottest year on record.

That is bad news for air quality levels.

"Air quality and climate are interconnected because the chemical species that affect both are linked, because the substances responsible for climate change and for the degradation of air quality are often emitted by the same sources and because changes in one inevitably cause changes in the other," WMO said.

It pointed for instance to how the combustion of fossil fuels emits carbon dioxide and nitrogen oxide into the atmosphere, which are not only heat-trapping greenhouse gases but can lead to the formation of pollutants like ozone and nitrate aerosols.

Researchers, meanwhile, widely agree that climate change is causing more intense and more frequent heatwaves, and that this in turn is leading to a growing risk of more severe wildfires, WMO said.

- 'Closely linked' -

"Heatwaves and wildfires are closely linked," said Lorenzo Labrador, a WMO researcher at the Global Atmosphere Watch network which compiled Wednesday's Bulletin.

"Smoke from wildfires contains a witch's brew of chemicals that affects not only air quality and health, but also damages plants, ecosystems and crops - and leads to more carbon emissions and so more greenhouse gases in the atmosphere," he said in the statement.

The 2022 data detailed in the report showed how heatwaves last year triggered wildfires in the Northwestern United States, leading to unhealthy air.

Soaring temperatures in Europe, accompanied by unusually high amounts of desert dust reaching the continent, meanwhile led to increased concentrations of both particulate matter and ground-level ozone pollution, it said.

While high-altitude, or stratospheric ozone provides humans with vital protection from harmful the ultra-violet rays of the sun, ozone close to the Earth's surface is harmful to human health.

It also reduces crop yield, with ozone-induced losses averaging 4.4 percent to 12.4 percent globally for staple food crops, and wheat and soybean losses as high as 15 percent to 30 percent in parts of India and China.

Delhi's PM10, PM2.5 Pollution Levels Declined 45% Since 2014: Minister

In a "big relief" for Delhi residents, the PM10 and PM2.5 levels have declined by an average of 45 per cent in the last 9 years, Delhi Environment Minister Gopal Rai said today.

Speaking to reporters after a meeting with officials of the environment department, Mr Rai said that work on a 'winter action plan' to tackle any rise in air pollution levels has begun.

The levels of particulate matter (PM) 10 and 2.5 usually start increasing from the last week of October and attain a peak in November when temperature plummets, requiring measures to check the poor quality of air, he added.

"There is news of big relief for Delhi's people. The PM 10 and PM 2.5, which are two important parameters of air quality and determine the level of air pollution in Delhi, have registered a downward trend since 2014 due to efforts of Delhi's people and the government," the minister said.

However, the Delhi government under the leadership of Chief Minister Arvind Kejriwal is determined to bring it further down, he said.

Citing data from past years, Mr Rai said that over the 9 years from 2014 to August 2023, the PM10 level has declined by 42 per cent. It was 324 in 2014, 295 in 2015, 303 in 2016, 277 in 2017, 277 in 2018, 230 in 2019, 187 in 2020, 221 in 2021, 223 in 2022 and it was 188 until August 2023, he said.

Similarly, the PM2.5 level has declined by 46 percent from 149 in 2014, 133 in 2015, 137 in 2016, 130 in 2017, 128 in 2018, 112 in 2019, 101 in 2020, 113 in 2021, 103 in 2022, and 81 till August 2023, the minister said while showing a chart.

He said the government on September 12 would hold a meeting of experts from 24 organisations associated with pollution mitigation and take their opinion for preparing the winter action plan.

Also, a meeting of 28 departments and agencies will be held on September 14 to seek their feedback on ways to tackle high levels of air pollution in the winter, Mr Rai added.

Police Withdraw Order To Shut Shops In Delhi's Daryaganj During G20 Summit

The Station House Officer of Daryaganj police station has withdrawn an order asking offices, shops, vehicle parking, DTC depot. etc in the area to remain shut during the G20 Summit.

According to the order, which was released on Sunday, all government/private offices, shops, commercial establishments offices, cinema hall, vehicle parking, banks and schools, DTC/cluster bus depot located at Rajghat, Asaf Ali Road, JLN Marg, Netaji Subhash Marg Nishad Raj Marg, Dayanand Road, Kedarnath Marg, Padamchand Marg and Ansari Raod Daryaganj and within the jurisdiction of Daryaganj police station were to be kept closed on September 7 from 10 pm to September 10 up to 10 pm for G20 Summit.

Later, the SHO issued another order on Monday cancelling Sunday's order.

An order regarding closing all government/private offices, shops, commercial establishments offices, cinema halls, vehicle parkings, banks and schools from 10 pm on September 7 to 10 pm on September 10 was circulated on Sunday. It has been withdrawn on administrative grounds and it may be treated as cancelled, the latest order read.

BJP Names Ex Deputy Chief Minister As Rajya Sabha Candidate From UP

The BJP on Sunday named former Uttar Pradesh deputy chief minister Dinesh Sharma as its candidate for the September 15 by-election to a Rajya Sabha seat from the state.

The bypoll has been necessitated due to the death of incumbent MP Hardwar Dubey, who was also from the BJP. The term of the seat is till November 2026.

Speaking to PTI, Dinesh Sharma thanked Prime Minister Narendra Modi, UP Chief Minister Yogi Adityanath and other senior party leaders for the opportunity to be a member of the Upper House of Parliament.

"I will work for the party to ensure that Narendra Modi ji becomes the prime minister for the third time," Sharma, who is a member of the UP legislative council, said.

Mr Sharma's election is all but certain due to the strong majority the BJP enjoys in the state assembly. Like Dubey, he is also from the Brahmin community.

In the 403-member UP legislative assembly, the BJP has 255 MLAs, while its allies Apna Dal (Sonelal) and NISHAD party have 13 MLAs and six MLAs respectively. New NDA partner SBSP has 6 MLAs in the Assembly.

The SP has 108 MLAs and its ally Rashtriya Lok Dal (RLD) has nine MLAs. Congress and Jansatta Dal Loktantrik have two MLAs each, while the BSP has one MLA. One seat (Ghosi) is vacant.

Mr Sharma was one of the two deputy chief ministers in the first term of the Chief Minister Yogi Adityanath-led government between 2017-22.

He held portfolios of secondary education, higher education, science and technology and IT and electronics.

After being replaced by Brajesh Pathak following the 2022 UP Assembly polls, Sharma had said that he will continue to strengthen the party to ensure that it emerges winner in the 2024 Lok Sabha polls.

"I will continue to work for the party and strengthen it. As a party worker, I will strive to ensure that the BJP emerges victorious in the 2024 Lok Sabha elections," Mr Sharma had earlier told PTI.

The 59-year-old leader has been a member of the Bharatiya Janata Party for long but emerged on the central stage of politics with his appointment as its National Vice President in August 2014 after the party's landslide victory in the parliamentary polls.

After he was made the in-charge of party affairs in Gujarat, his stature in the party grew immensely.

He was first elected as the Mayor of Lucknow in 2008. He stood for re-election in 2012 and defeated his nearest rival Neeraj Bora of the Congress (now a BJP MLA from Lucknow North) by over 1.71 lakh votes.

It was on his invitation that Prime Minister Narendra Modi had attended the Lucknow Ramlila in October 2016.

He also played a key role in the organisation (2014-15) during its membership drive when 10 crore new members were roped in.

Mr Sharma has also been a party observer to Haryana for electing its chief minister and to Rajasthan to elect the state BJP chief.

He was also the state chief of the UP Mayor Council from 2007 to March 18, 2017.
